Legal
508(c)(1)(A) Status
Faith Education Ministry operates as a 508(c)(1)(A) faith-based church/religious organization under the Internal Revenue Code. Our subordinate affiliate, Faith Education Ministry NA, operates as a 501(c)(3) under our group exemption and processes charitable donations on behalf of the ministry.
What Is a 508(c)(1)(A) Organization?
A 508(c)(1)(A) organization is a church, or convention or association of churches, that is mandatorily excepted from taxation under federal law. Unlike 501(c)(3) organizations, a 508(c)(1)(A) entity is not required to apply for tax-exempt status with the IRS — its authority comes from statute, not from an agency determination.
Key Distinctions
• No IRS determination letter required — Recognition comes from statutory mandate rather than IRS approval.
• No Form 990 filing obligation — 508(c)(1)(A) churches are exempt from the annual Form 990 reporting requirement applicable to many 501(c)(3) organizations.
• Donor contributions may be tax-deductible — Gifts to Faith Education Ministry NA, our 501(c)(3) subordinate, are tax-deductible to the extent permitted by law. Consult your tax advisor for guidance specific to your situation.
• Constitutional protections — First Amendment protections apply to the organization's ministerial and religious activities.
